Legal Counsel, Regulatory Team

Alliance Defending Freedom is looking for a highly professional Legal Counsel to join us in our Scottsdale, AZ or Lansdowne, VA office. As Legal Counsel, you are a vital part of the US Legal Division Team. In this role, you will report to the Senior Counsel, Director of Regulatory Practice. Legal Counsel is an experienced attorney capable of undertaking complex litigation, particularly regulatory litigation including challenges to federal agency action under the Administrative Procedure Act (APA), and appellate advocacy without substantial oversight by senior attorneys. Legal Counsel litigates civil actions with emphasis on federal administrative law, structural constitutional claims, Administrative Procedure Act claims, First Amendment law, and 42 U.S.C. § 1983 civil rights actions; also drafts public comments and engages in meetings on federal regulatory matters; trains junior attorneys in basic civil litigation and regulatory advocacy; drafts legal documents; tracks and reports on federal agency and executive branch actions; advises clients as to legal rights, and practices other phases of law by performing the following duties. Legal Counsel also oversees administrative and paralegal support functions.

Your Essential Responsibilities:

In this position, you will:

  • Conduct research, interviews clients and witnesses

  • Prepare and respond to written discovery; conduct and defend depositions

  • Draft pleadings and briefs and represent clients in court and before quasi-judicial or administrative agencies of government

  • Draft and file public comments, and engage in meetings and outreach, on government regulatory matters

  • Tracks and report to the ADF team and to allies on federal agency and executive branch actions

  • Interpret laws, rulings, and regulations for individuals and businesses

  • Confer with colleagues to establish and verify basis for legal proceedings

  • Cooperate with Development team, including speaking engagements and other events

  • Review in-house contracts and legal issues

  • Interact with media regarding cases and issues

  • Advise network attorneys and allies on legal issues within areas of competence

  • Network and develop relationships with allies, network attorneys, and/or potential network attorneys

Other Responsibilities (Non-Essential):

  • You will be asked to perform related duties or special projects as assigned.

Education and/or experience:

  • Bachelor’s degree

  • J.D., licensed to practice law in relevant jurisdiction

  • Experience litigating administrative law, structural constitutional claims, and Administrative Procedure Act challenges to regulations and administrative actions
