The Minnesota Department of Corrections (DOC) is seeking an Associate General Counsel to join a collaborative team of attorneys. Associate General Counsels perform the following functions:

  • Represent the DOC in state and federal habeas proceedings.

  • Represent the DOC in administrative proceedings related to employment and public-services discrimination.

  • Provide legal advice to management and executive team members on a wide variety of complex issues, including prisoner civil rights, criminal sentence administration, labor and employment, and data practices.

  • Manage federal civil rights and state tort litigation handled by the Attorney General’s Office.

This position involves significant legal research and writing, workshopping strategy with a collegial team of attorneys, and quickly learning new areas of the law or details of DOC operations.

To promote a culture of flexibility, the DOC offers staff a hybrid work environment that varies by team, position, and business needs. This position will work in-office one day per week and for occasional in-person meetings. Completion of a telework agreement will be required. Teleworking employees are required to live in Minnesota or a bordering state in a county along the Minnesota state line.

Minimum Qualifications

To be qualified for and considered for this position, applicants must meet all of the minimum qualifications listed below. Ensure that your resume contains descriptions of your work experiences sufficient for comparison against the requirements stated below and indicate the beginning and ending month and year for each job held.

  • Juris Doctorate (J.D.) from an ABA-accredited law school.

  • Licensed to practice law in the State of Minnesota or ability to become licensed in Minnesota within 120 days of appointment to the position and current with continuing legal education requirements.

  • At least 5 years of experience as a practicing licensed attorney (judicial clerkship experience will count toward this requirement).

  • Significant experience within the last 5 years with conducting legal research and drafting legal documents akin to dispositive motions, memoranda of law, briefs, or court opinions.

Preferred Qualifications

The following qualifications are strongly desired of applicants seeking consideration for this position:

  • Extensive knowledge of federal and state anti-discrimination laws.

  • Employment-law related experience in a public-sector work environment.

  • Experience advising or representing government entities regarding issues unique to public administration and government services, such as procurement, data practices, administrative rule-making, etc.

  • Prosecutorial experience.

  • Experience in a general counsel role or other direct client contact experience involving researching and communicating legal advice to operational decision makers.

  • Experience representing clients in civil litigation or administrative proceedings.

Physical Requirements

Additional Requirements

The selection process may include screening the top candidate(s) on their criminal history, predatory offender registration, offender associations and/or other applicable background information in accordance with Department of Corrections’ policy. Top candidate(s) must pass a criminal history check which includes successful completion of all sentencing and/or restitution requirements of law enforcement jurisdictions, including probation.

Employment history/reference checks, including incidents of sexual harassment, will also be conducted on the top candidate(s) in accordance with Department of Corrections’ policy. This may include a review of job performance and discipline records.

New employees will be fingerprinted within the first 30 days of employment.
