Minimum Qualifications Qualifications:• At least eight (8) years of post-graduate legal experience that includes experience leading/managing all aspects of the complex rulemaking process. • Experience in any or all or the following is strongly preferred:o First amendment experience. o Expertise in technology and related legal issues, privacy, and data security. o Existing relationships or connections to related/impacted-stakeholder groups.o Prior experience leading and coordinating teams of attorneys. o Prior New York State legislative experience.o Experience representing an agency, entity, and/or high-level principal at meetings, events, and other public-speaking engagements. • Excellent legal analysis, legal writing and editing skills, and presentation skills. • Highly proactive and responsive with excellent relationship management skills. • Ability to work well independently and collaboratively with a large group of attorneys.Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that OAG attorneys be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.

Duties Description Opportunity for Attorneys w/Experience Leading Complex Rulemaking EffortsThe Office of the New York State Attorney General (OAG) is seeking an attorney with experience leading complex rulemaking efforts and teams to work on drafting regulations implementing landmark legislation intended to preserve the online privacy of young people and protect them from the harms of addictive social media feeds. The selected attorney will be hired as a Special Counsel for a 24-month term with the possibility to extend for an additional 12 months. The Special Counsel will report to the Chief Deputy Attorney General for Economic Justice and be located in the New York City office. In June 2024, New York State established the nation’s most stringent protections to safeguard young people on social media. The SAFE For Kids Act, the first bill of its kind to be signed into law in any state across the nation, requires social media companies to restrict access to addictive feeds on their platforms for users under the age of 18. The New York Child Data Protection Act prohibits online sites and connected devices from collecting, using, sharing, or selling the personal data of anyone under the age of 18. Both laws provide the OAG with regulatory authority, with the SAFE For Kids Act requiring final OAG regulations before it takes effect; the OAG has been further authorized to enforce both laws and ensure compliance. Duties: • Manage the rulemaking team, including attorneys, policy staff, and other professional and support personnel. • Lead the OAG’s effort to draft and refine regulations implementing the SAFE For Kids Act and the Child Data Protection Act.• Supervise complex legal analysis projects and provide technical interpretation to facilitate and support the rulemaking process and implementation of these new laws.• Provide strategic guidance and advise and brief OAG leadership on key issues. • Use subject matter expertise to engage internal and external stakeholders in the design and evaluation of proposed regulations.• Collaborate with Division of Economic Justice attorneys, policy staff, and other OAG personnel on effective rulemaking, implementation, and enforcement strategies.
