The Marion County Public Defender Agency provides legal representation for Marion County residents who cannot afford to hire their own lawyer in matters involving liberty interests, including criminal cases. Our services are provided as a public service. We work with the felony, misdemeanor, Title IV D, civil commitment, and juvenile courts. We also work on cases related to termination of parental rights as well as appeals. Our agency also offers education, services, and programs focused on different ways to serve jail sentences. The agency is able to do this by cultivating a productive, collaborative, and compliant work environment in order for our workforce to meet the needs of the constituents of Indianapolis and Marion County.

Job Summary

This position is responsible for working in partnership with the Chief Public Defender to ensure the successful advancement consistent with the goals and policies of the Public Defender Agency. Serves as legal and policy adviser to the Chief Public Defender on issues related to budget, personnel, attorney and support staff training, representation of indigent clients in complex litigation cases and commission standards. Also advises the Chief Public Defender on relationships with Public Defender Board, City-County Council, and Indiana Public Defender Commission members as well as furthering other necessary county and state alliances. Responsible for overseeing and mentoring the Public Defender Agency attorney and support staff in complex major felony litigation, forensic litigation, and life without parole and capital litigation. Acting chief duties shared with Chief Counsel in the absence of the Chief Public Defender or when otherwise authorized to do so. Independent judgment is regularly utilized when there are no available policies and procedures. Independent actions and judgment are exercised in making decisions that are complex in nature and have considerable impact on Public Defender Agency policy. Decisions and actions may be controlled by state and federal laws. The actions and decision-making process allow for considerable latitude in making informed judgments, quick decisions, or decisions without benefit of consultation. The incumbent is expected to exercise initiative, creativity, and independent problem-solving skills. This position reports to Chief Public Defender.

Position Responsibilities

  • Monitors compliance of each agency division with the caseload and training requirements set by the Indiana Public Defender Commission Litigate complex cases to include life without parole and capital cases

  • Advises the Chief Public Defender and takes primary responsibility of rule and policy changes implemented by the Indiana Public Defender Commission and their impact on Agency operations

  • Responsible for training and mentoring attorneys to litigate cases involving complex forensic issues and complex cases including life without parole and capital cases

  • Maintain contact with other indigent defense providers to stay current in the training and delivery of indigent criminal defense services

  • Supervises personnel regarding issues pertaining to advancement, discipline, hiring and termination of employees

  • Participates in budgetary decisions with the Chief Public Defender, Chief Counsel, Chief Operating Officer, and Chief Financial Officer

  • Serves as Chief Public Defender’s proxy at inter-agency meetings and working committees

Qualifications

Juris Doctorate and law license required. Minimum of ten (10) years of practicing criminal law. Must be major felony and murder qualified. Strong verbal, written, communication and presentation skills are required along with top level interpersonal and facilitation skills. Computer knowledge a must. Must have valid driver’s license.

Preferred Job Requirements and Qualifications

Prior experience in litigating death penalty and life without parole cases and prior experience in training and supervision is preferred.
