Position Information: The legal unit is the legal advisor to the director, all divisions, and eight regional offices of the department on all matters affecting the department and is the legal advisor to the FWP Commission (“commission”) on all matters affecting the commission. The unit represents and defends the department and commission in administrative proceedings before state and federal agencies and bodies and in litigation before all levels of state and federal courts. This representation requires specialization in complex areas of natural resource law, including, but not limited to: Montana water law; the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA); Indian (Tribal) Law; the National Environmental Protection Act; the Montana Environmental Policy Act; the Montana Administrative Procedure Act and laws governing open meeting and public participation in governmental operations; Federal Energy Regulatory Commission (FERC) regulation of hydropower dams; state and federal regulation of wildlife and habitat, such as the Endangered Species Act and state statutes; federal funding laws and regulations for fish and wildlife management; property law; regulation of hunting and fishing (including licensing); state statutes regulating the introduction and importation of wildlife within the state; state statutes regulating game farms and other commercial use of wildlife; and other state and federal natural resource statutes. The Legal Unit works to assure that the agency’s activities and programs are based on adequate legal authority, fulfill the agency’s legal mandates, and are implemented in a manner that insulates from legal challenge. Chief Legal Counsel experiences the pressures associated with the practice of law, including judicial and administrative trials and hearings, supervision and coordination of case development and legal strategies, and working with an ardent and demanding public constituency. Chief Legal Counsel performs work indoors in a typical office environment with light lifting and extensive computer use daily. Chief Legal Counsel is regularly required to stand, sit, and use hands and fingers to operate a computer and telephone. Chief Legal Counsel may sit for extended periods while reviewing detailed data, and typically works regular business hours and a standard 40-hour work week. Some travel (20%) and extra work hours are required. Job Overview: Chief Legal Counsel is responsible, under broad policy guidance and direction from the director, the chief of staff, and commission, for providing competent legal counsel in all phases of the agency’s and commission’s duties and responsibilities. These legal services are provided primarily to the director, the chief of staff, regional supervisors, division administrators, and the commissioners. Chief Legal Counsel is responsible for the administration, management, and supervision of six attorneys, two paralegals, and three program specialist. Chief Legal Counsel is responsible for directly handling many complex and difficult judicial and administrative cases involving the agency and commission, and for providing legal advice on many complex and difficult issues before the agency and commission. Chief Legal Counsel is responsible for: providing legal advice and representation on agency policy and legislation, including legislative strategy, that affect both the short-term and long-term operations and goals of the agency; developing strategy and prosecuting, defending, negotiating, and settling cases; and providing legal advice and supervision of staff legal counsel in a number of specialized areas such as personnel matters, complex real estate transactions, precedent-setting natural resource issues, and administrative practices. Chief Legal Counsel also represents and advises the commission on these matters where appropriate. Chief Legal Counsel is also responsible for other day to day legal service needs of the agency. Essential Functions: Chief Legal Counsel is responsible, under broad policy guidance and direction from the director, the chief of staff, and commission, for providing competent legal counsel in all phases of the agency’s and commission’s duties and responsibilities. These legal services are provided primarily to the director, the chief of staff, regional supervisors, division administrators, and the commissioners. * Serves as key legal advisor on complex and difficult judicial and administrative cases and issues involving the agency and commission. * Provides legal advice and representation on agency policy and legislation, including legislative strategy, that affect both the short-term and long-term operations and goals of the agency. * Participates in the development and implementation of FWP legislative objectives; provides legal guidance and advice in the representation of the department with the legislature, congress, tribal governments, and other policymakers. Supervision: This position directly supervises six lawyer positions, with indirect supervision of five non-lawyer positions (who are supervised by the Deputy Chief Legal). Knowledge, Skills and Abilities: This position requires extensive knowledge of: legal research methods and techniques; arbitration, mediation and negotiation; court, quasi-judicial administrative, and legislative proceedings, including rules of procedure, precedents, policies, practices and customs; and state and federal statute, case law, and constitutional provisions affecting the natural resource, real property, administrative, and personnel programs administered by the agency. A qualified candidate possesses thorough knowledge of: the rules, policies, practices, precedents, and organizational structure of the natural resource, real property, administrative, and personnel programs administered by the agency; state and agency administrative practices and procedures; and rules, policies, and requirements of supervision. A qualified candidate possesses considerable knowledge of the organization of state government, and how the agency programs interrelate with those of other state and federal agencies, the legislature, and the private sector. Extensive and specialized knowledge is required in the following areas of law: state and federal constitutions; administrative law; Montana statutes providing for open meetings and public participation; natural resource law; FWP statutes and rules; Montana water law; personnel law; real estate and property law; contract law; Tribal law; Montana Administrative Procedures Act; National and Montana Environmental Procedures Acts; Endangered Species Act; Federal Power Act; and federal Superfund statutes, including but not limited to CERCLA and the Reauthorization Act. This position also requires the ability to analyze difficult and complex legal problems and to organize a course of action; apply sound judgment to complex and sensitive factual and public policy situations;organize and provide general supervision to a diverse and highly specialized staff; represent the agency in judicial, administrative, and legislative hearings before managers and officials of other agencies, committees, and task forces and in other interaction requiring in-depth knowledge of agency obligations, authority, and functions; write clearly and concisely for both lawyers and non-lawyers; organize and makeeffective and clear written and oral communications and presentations; negotiate, arbitrate, and mediate disputes and agreements; act with initiative, good judgment, and tact; deal effectively with confidential and sensitive material; and, establish and maintain effective working relationships with employees, other agencies, and the public. Minimum Qualifications: The knowledge, skills, and abilities of this position are normally attained through combination of education and experience equivalent to a juris doctorate degree, admittance to the Montana Bar Association, andnine years of practicing law, four of which are in the natural resource, administrative and personnel areas administered by the agency.
