GENERAL PURPOSE OF THE JOB: The Director, Sr. Corporate Counsel will be a member of the regulatory team within the Justice League. The individual will provide legal guidance and support to the Company on regulatory and compliance related matters as they arise in the context of: (1) the development and deployment of artificial intelligence ("AI") technologies used in DaVita's clinical and business operations; and(2) the development of Electronic Health Record (EHR) software and other digital products that are used to facilitate and support the provision of clinical care. The individual will serve as the day-to-day AI and IT legal support and strategic partner to the AI workstream of the DaVita Product Organization.

This position requires knowledge of IT development processes and an understanding of AI technologies, as well as experience with the Federal healthcare regulatory laws, including the False Claims Act, the Anti-Kickback Statute, the Stark Law, and the Civil Monetary Penalties and Beneficiary Inducement laws and their implementing regulations. Experience supporting healthcare transactions is also a plus.

ESSENTIAL DUTIES AND RESPONSIBILITIES: Serve as legal regulatory counsel and strategic partner to DaVita, with an emphasis on healthcare laws and regulations. In partnership with other DaVita attorneys and compliance teammates, assist business clients responsible for AI and Clinical IT product development in identifying and resolving legal/regulatory matters. Advise on compliance with federal and state health care industry laws and regulations. Develop working relationships with business clients, as well as legal and compliance partners.

MINIMUM QUALIFICATIONS: Juris Doctorate degree with approximately 6 years' experience in legal practice representing businesses and/or organizations in the health care and/or health care IT industry. At least one state bar admission and in good standing, with the ability to waive into Colorado, if needed. In-depth knowledge of healthcare regulations related to digital health and medical technologies, the Medicare program and health care fraud and abuse laws and regulations. Experience negotiating and drafting technology contracts, data agreements, and other healthcare-related legal documents. Excellent written and oral communication skills. Ability to manage multiple matters and priorities at one time in a fast-paced environment. High degree of maturity and professionalism and the ability to work in a collaborative, team environment.
