Compensation:
Agency Attorney 1: $110,000 - $115,000
Agency Attorney 2: $120,000 - $125,000
Agency Attorney 3: $130,000 - $140,000
Summary:
This position will be responsible for managing all aspects of a No-Fault caseload.
Responsibilities:
Handle No-Fault claims, litigation, arbitration (including inter-company arbitration for loss transfer), and uninsured motorist claims.
Answer complaints, prepare motion papers, draft discovery requests and responses. including writing memoranda of law.
Review expert and medical reports, obtain subpoenaed records, and analyze both legal and factual issues.
Attend court conferences, argue motions, and defend cases in arbitration. No-Fault cases are processed in the Supreme and Civil Courts across all five boroughs as well as in Nassau County.
Oversee the activities of outside counsel to ensure quality and manage costs, as well as supporting No-Fault anti-fraud initiatives and the Special Investigation Unit by administering Examinations Under Oath (EUO) for both claimants and providers.
Provide managerial and supervisory oversight to the unit's paralegal team.
Advise management and claims examiners on the applicability and changes regarding No-Fault law.
Effectively research and implement special projects as requested by the General Counsel.
Education and Experience
Admission to the New York State Bar; and either "2" or "3" below
One year of satisfactory United States legal experience subsequent to admission to any state bar; or
Six months of satisfactory service as an Agency Attorney Intern
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
Note:
In addition to meeting the minimum Qualification Requirements: To be assigned to AL II, candidates must have one year of experience at Assignment. Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.
Desired Skills
The incumbent must possess the following skills:
Experience litigating No Fault matters.
A working knowledge of Regulations 68 and 83 and basic knowledge of the No Fault fee schedule and medical terminology are necessary.
Excellent oral and written communication skills.
Working knowledge of Windows, Lexis Nexis, etc.
Candidates should have good interpersonal and analytical skills including the ability to solve complex legal problems.
