JOB DESCRIPTION:

This is investigative and protective services work inspecting retail locations and production facilities for Maine’s medical and adult use cannabis industries throughout the State in accordance with statutory requirements. Responsibilities include reviewing funds, charges, inventory, taxes, and accounts of cannabis related businesses; ensuring consumer and workplace safety; and providing subject matter expertise to cannabis industry stakeholders in a comprehensive capacity.

Work is performed under limited supervision. 

TYPICAL DUTIES INCLUDE:

  • Inspects, analyzes, and files written reports for cannabis retailers and production facilities to ensure compliance with applicable laws, rules, and regulations.

  • Analyzes, evaluates, and verifies applicant and facility information to ensure licensees are covered with the appropriate type of license.

  • Advises prospective and current licensees on license denials, suspensions, and regulatory violations to provide counsel on possible corrective actions.

  • Explains cannabis industry policies, guidelines, rules, and regulations to provide information to current and future licensees, healthcare workers, public officials, and private groups.

  • Reviews and investigates complaints to determine validity, circumstances, and necessary corrective action.

  • Identifies, researches, and monitors trends related to cannabis sales, production, consumption, and distribution to inform office operations.

  • Coordinates planning and implementation of corrective action plans and evaluates licensee progress to maintain consistent compliance.

  • Inspects and verifies complex financial, tax, licensing, and inventory records and reports to determine accuracy of information.

  • Audits licensees’ self-sampling protocols to ensure proper procedures are used and viable samples are obtained for health and safety testing.

  • Collects cannabis product samples for health and safety testing as needed to verify licensee data and ensure safety of products.

  • Serves as a subject matter expert for law enforcement officials and other governmental agencies in investigations involving cannabis related subject matter.

  • Refers identified non-cannabis infractions to relevant regulatory agencies and assists in resolving their compliance issues to encourage total compliance with all State rules, laws, and regulations.

  • Compiles and provides evidence and testifies as an expert witness in court and at administrative hearings as needed to address cannabis violations.

  • Conducts workshops and speaking events and develops and provides training and education materials to support office goals.

  • Tracks, seizes, and destroys contaminated and unsafe products using proper methods to ensure public health and safety.

  • Evaluates and advises licensees on facility safety and security measures to maintain safe work environment and track cannabis sales.

    KNOWLEDGES, SKILLS AND ABILITIES:

  • Knowledge of applicable adult use and medical cannabis laws, rules, regulations, policies, and procedures.

  • Knowledge of security practices and equipment.

  • Knowledge of cannabis production facilities and processes.

  • Knowledge of cannabis industries, products, and packaging.

  • Knowledge of Inherently Hazardous Substances (IHS) related to cannabis extraction.

  • Knowledge of cannabis sample auditing, contamination mitigation, and quarantine procedures.

  • Knowledge of court and administrative processes and procedures.

  • Knowledge of accounting and record keeping procedures.

  • Knowledge of investigative techniques.

  • Knowledge of business management practices.

  • Knowledge of pesticide use and application.

  • Ability to independently plan and organize work.

  • Ability to communicate effectively orally and in writing.

  • Ability to assess information, reach logical conclusions and make sound decisions.

  • Ability to conduct interviews to obtain information.

  • Ability to establish and maintain effective working relationships.

  • Ability to interpret and explain provisions of laws, rules, and regulations.

  • Ability to write clear and concise reports.

  • Ability to conduct inspections and reviews.

  • Ability to testify as an expert witness in court and administrative hearings.

    MINIMUM QUALIFICATIONS:

  • Intermediate education, training, and/or experience directly related to investigations, auditing, business analytics, cannabis industries, and/or a regulatory field.

    PREFERENCE WILL BE GIVEN TO APPLICANTS WITH:

  • Preference will be given to applicants with experience in conducting in depth investigations, working in a regulatory environment, and those with familiarity with Maine cannabis statutes and program rules.
