Who are we?

At the Bureau of Motor Vehicles (BMV) under the Secretary of State's office, we are committed to ensuring the fair and efficient adjudication of motor vehicle violations. Our mission is to uphold public safety while providing a transparent hearing process. We are seeking a motivated and skilled Assistant Motor Vehicle Hearings Examiner to join our team and contribute to our goals.

As an Assistant Motor Vehicle Hearings Examiner, you will play a vital role in the adjudication process by conducting hearings related to repeat violations, provisional licenses, and accidents. Your expertise will help protect public safety by requiring good driving behaviors while ensuring fairness and accuracy in our decisions.

Work hours for this position are Monday-Friday 8:00am-5:00pm.

Responsibilities include but are not limited to:

  • Conduct Hearings: Oversee hearings for repeat violations, provisional licenses, and accidents, ensuring timely completion. Clearly communicate with participants to explain hearing procedures, treating all participants with respect and consideration. Hearings are primarily conducted by phone or video conference.

  • Decision-Making: Analyze evidence and make findings of fact to uphold, rescind, or modify Bureau actions. Clearly articulate logical, evidence-based decisions orally and in writing.

  • Case Management: Ensure the timely resolution of hearings while also issuing continuances when necessary to allow parties time to gather relevant witnesses and documentation.

  • Pre-Hearing Conferences: Facilitate discussions to clarify the process, identify key issues, and allow petitioners or attorneys to review case materials.

  • Document Review: Assess hearing requests, motor vehicle records, and investigator reports to evaluate evidence and identify ancillary issues.

  • Research and Information Gathering: Communicate with witnesses, law enforcement, and other stakeholders to gather case information and prepare comprehensive hearing files.

  • Hearing Scheduling: Organize and schedule hearings, coordinating with relevant parties to ensure dockets are set efficiently throughout the State.

  • Communication: Answer questions from hearing participants including petitioners, attorneys and witnesses with courtesy. Maintain good communication with all agency staff to ensure efficient operations.

  • Assist with administrative functions to support the Hearings Division as needed.

    In order to be successful, you must have:

  • Knowledge of the rules of evidence pertaining to a fair and impartial hearing.

  • Ability to conduct administrative hearings.

  • Ability to communicate and deal effectively with a variety of people in stressful personal contact situations.

  • Ability to analyze facts, issues, and testimony and arrive at sound decisions.

  • Ability to prepare written decisions in an understandable manner.

  • Ability to work independently.

  • Knowledge of Motor Vehicle Laws (Title 29 -A)

  • Familiarity with Office 365 and video conferencing programs.

    MINIMUM QUALIFICATIONS: ( Entry level knowledges, skills, and/or abilities may be acquired through, BUT ARE NOT LIMITED TO the following coursework/training and/or experience.)

  • A four (4) year combination of training, experience, and/or education providing a working knowledge of the adjudication process relating to motor vehicle hearings and/or related fields.

    Preference will be given to candidates with:

  • Candidates with 4-year degree (criminal justice, paralegal, etc.)

  • Excellent communication and interpersonal skills including effective written and verbal communication skills, ability to read and interpret statutes, rules and case law.

  • An understanding of basic principles of due process.

  • Previous experience in administrative law or adjudication processes.

  • Familiarity with Motor Vehicle Laws (Title 29-A) and the rules of evidence.

  • Strong analytical skills and experience in case management.
