About you and this role
Dowhas an opening for aLand and Right of Way Specialistlocated inHouston, TX or Angleton, TX.The Land & Right of Way Specialist will be working as part of the Dow Gulf Coast Pipeline (GCPL) Right of Way (ROW) Team, which manages approximately 3,500 miles of pipeline right of way and other real estate for Dow Gulf Coast Pipeline. This role includes performance of the primary functions necessary to acquire and maintain legal property rights on third party (non-Dow) property for the operation and maintenance of the GCPL pipeline system.
Responsibilities
Negotiate agreements for ROW acquisition, fee property, extensions and renewals of expiring leases, landowner and tenant damages, temporary workspace, and rights of ingress and egress to facilitate the operation and maintenance of the GCPL pipeline system on behalf of Dow and its various pipeline subsidiaries.
Communicate and correspond with landowners, tenants, governmental and regulatory agencies, attorneys, surveyors, engineers, environmental consultants, other pipeline companies, Dow Commercial / Business Group and GCPL field technicians.
Draft and prepare legal documents under the direction of the Dow Legal Department and route for execution by the appropriate corporate officer.
Conduct courthouse title searches to determine land ownership, liens and prior encumbrances.
Negotiate and settle damage claims with landowners and tenants resulting from Dow pipeline construction, operations and integrity management (IMP) activities. Request and document payment and receipt of damages.
Provide periodic real estate and ROW support to other Dow sites serviced by the GCPL system (Freeport, Texas City, Seadrift, Plaquemine, Grand Bayou Operations and St. Charles).
Assist Dow Commercial group with pipeline leases, divestments, connection agreements and other transactions involving GCPL assets.
Communicate extra-ordinary budget projections to GCPL Cost Accountant including anticipated deviations in rentals for leased properties, salt royalties, ROW easement extensions and legal costs or settlements.
Prepare Environmental Assessment Requests for all transactions involving real property to comply with requirements of Dow Article IX. Coordinate these requests with Texas and Louisiana Environmental Groups.
Utilize the ROW database (CLSLiNK) for all pipelines and properties and ensure that pertinent information for new transactions is submitted for data entry.
Disseminate information received from outside sources to appropriate Engineers and Activity Leaders for upcoming external third-party projects that could affect Dow’s pipelines.
Evaluate easement rights and potential qualification for reimbursement on third party encroachments where a pipeline adjustment is required. Complete reimbursement agreements following Gulf Coast Pipeline’s prescribed procedure for qualifying projects.
Review and approve Letters of No Objection for third party encroachments. Coordinate analysis of potential impact to pipeline with Dow Pipeline Technicians and Area Run Plant Engineers and include necessary requirements in issued letter.
Provide ROW information to realtors, title companies and developers. Coordinate line locating with field technicians when necessary.
Attend pre-construction meetings for third party encroachments on Dow’s pipelines.
Supervise contract ROW Agents staffed for new pipeline project ROW acquisition.
Request and coordinate land surveys to support ROW transactions and obtain survey plats for legal document exhibits.
Provide information on Gulf Coast Pipeline assets to Dow Tax departments in Texas and Louisiana.
Perform tasks in a safe manner and maintain full compliance with all Dow safety procedures. Take responsibility for the safety performance of contract right-of-way agents.
Qualifications
A minimum of a High School Diploma or GED equivalent with 5 years industry experience - in Right-of-Way, Oil & Gas, Pipeline or Real Estate related field OR a bachelor’s degree with 3 years of industry experience- in Right-of-Way, Oil & Gas, Pipeline or Real Estate related field.
Understanding of pipeline alignment sheets – stationing, property lines, off-sets, scale, points of intersection, etc.
A minimum requirement for this U.S. based position is the ability to work legally in the United States. No visa sponsorship/support is available for this position, including for any type of U.S. permanent residency (green card) process.
Preferred Skills
7 or more years of industry experience.
Strong communication skills, both verbal and written, for dealing with landowners, tenants, governmental and regulatory agencies, attorneys, surveyors, engineers, environmental consultants and representatives of other pipeline companies.
Real Estate Background – understand basic real estate principles, ownership and easement rights, Texas and Louisiana Legal Real Property descriptions – metes and bounds, township and range, survey drawings.
Basic knowledge of various agricultural land uses.
Document interpretation – familiarity with real estate contracts, easements, licenses, leases, servitudes, sales agreements and requirements for recordable documents – form, execution, acknowledgement, etc.
Fundamental knowledge of governmental regulations for gas and liquid pipelines.
Basic accounting – ability to calculate salt royalty payments, fractional real estate interests, indexed payment escalations.
Organizational skills – project prioritization, simultaneous management of multiple projects and ROW issues.
Computer skills – Proficiency in Word, Excel, CLSLiNK or other ROW database and use of Internet for landowner and real estate searches.
